A Clarion call to protect centurion old postal services


Despite our desire to maintain peace and tranquillity for the advancement of service and the workers, we have been pushing again and again towards the wall and forced us to take confronting position just in order to save the service and its workers.
                During   the July settlement, we were optimistic that the Postal Board would honour its commitments which were given in writing and led a peaceful passage for better improvement of service. Perhaps it is our apprehension, that it may be due to the clear mandate of some sitting at the decision taking level with the collusion of some courier agencies or with foreign forces which have taken pledge to pull to pieces the postal from Govt. Services.
                When the department introduced freight carrier through Air India, we record our observation that it would not improve service but deteriorate. But nobody hears. What happened? The freightcarrier has been dropped after one year resulting in the known minimum loss of 300 crores! Just to justify the weight of the freighter carrier, speed post and other articles were back routed and inordinate delay was noticed resulting hue & cry from the circle heads too.            
The very same coteries which were responsible for the freighter carrier,is now annoying to introduce L1 & L2 in sorting despite the fact that they know very well that it will lead to delay in delivery and cause inconveniences to the staff. The inordinate delay in delivery of speed post articles within intra circle resulted in growth of couriers in towns. If there is a loss of even one rupee, the contributory factors are misused against the innocent officials. Whereas for the known Rs 300 crore loss, who was held responsible? What action was taken against them? Whether the same persons’ harpingon  L1& L2 will be taken forward as a reward for the loss caused by them in freighter carrier? We are suspecting that as such in the past many senior postal board members and senior officers became the consultants of couriers and licence holders of franking machines to loot the postal revenue.Is there any lobby or a conspiracyin existence in the Directorate for deterioration of the postal services leaving behind the brighter chance for the growth and development of postal service?.
Can the department come out with the real picture about the realisation of BNPL dues to be cleared by the firms? One institution inChennai has not paid BNPL amounting to the tune of 14 lakhs over nine months despite the fact that it should have been cleared within a month.Crores of rupees are being kept unrecovered amount under BNPL. Is it real business, the department is entertaining now? Without settling the existing loopholes in the service and revamping the service by motivating the staff, the department proposes to introduce L1 & L2 with the definite intention to cause delay in delivery of letters.Can we remain mute spectators allowing the things or will it not be our responsibility to resist such move from the point of a constructive and disciplined organisation? This is the million dollar question before us.
                The Secretary, Department agreed to revise the cash handling points for GDS and also to give protection of TRCA. It was agreed to consider revision of bonus ceiling to GDS as Rs 3500/-. The proposals for the above were simply turned down by the internal finance (not Finance Ministry). Shall the postal Board not be vested with powers to set aside the unwarranted objections raised by IFW and honour its commitments in writing with unions during July agreement? Payment of minimum wage to casual labourers as per 6th CPC wages is the right as per Supreme Court and earlier orders of DOPT. But this has been denied repeatedly by internal finance by raising unwarranted queries and calling for details? What the Postal Board is doing?
                The IPS officers started their lobbies for the seventh cadre review! Even some minutes were issued for the discussions had with IPO/ASPOs! Whereas more than seven meetings were held so far but there is no minutes; no process. Still we are remaining in the in the initial stage only. The delay over three years in deciding cadre review exhibits the unfairness being extended towards the lowest cadres of the department. The cry of the system administrators could not reach the deaf ears. The acceptance to allow for IPO/Group B exam of Postmaster Grade I officials has not been honoured.
                There is no periodical meeting with unions over eight years. There was only one Departmental Council meeting held over six years. The Department is bluffing in the JCM National Council that the meeting are being held regularly in the Postal Department! It appears in the JCM National Council minutes also. Is it not shameful to give such false reply to the JCM National Council, the biggest body constituted by the Govt of India to redress staff grievances? There is no action yet by the department for acceptance of nomination from postal side to represent the national council.
                The postal workers’ distress has reached the climax and they are not in a mood to await further with hopes any longer as they are totally ignored and neglected by the authorities.There is a sign of desperation and frustration everywhere and in every one’s mind due to protraction in finding the first cadre review proposals where the powers started silently to pursue their seventh cadre review.
                Inspite of the best efforts made by the Federations and unions to proceed cautiously, the mounting discontentment and dissatisfaction prevailing among themasses of postal workers due to the firm determination of the Govtand Postal Board in deterioration of mail services by the proposed L1 & L2 introduction arbitrarily against the wishes of the postal workers, are now finding exposition through sporadic actions here and there like Karnataka, Kerala & Maharashtra Circles.
                All these incidents are but writing on the wall and should serve as a pointer to the authorities responsible for running the administration in the country. They should take a note of it before it is too late.This is our last word and in a sense and a warning to the authorities. Let us hope that good sense will prevail and everything will be considered with a changed outlook so that the postal workers are enabled to serve the postal department with contentment and zeal and render every possible for cause of service in the current days of competition.
Let us therefore organise the workers for a massive strike from 17.01.2012 and record our protest and discontent demanding a fair settlement on all the charter of demands.

            On 27.12.2011, Discussion on 25 point Charter of Demands has been held with the Postal Board -Member (Personnel), Member (Operations), Member (PLI) and Member (Planning). The discussion lasted for eight hours. Even though the staff side has elaborately explained all the demands raised in the Charter, there was no favourable or result-oriented settlement on any of the demands. Thereafter the Central JCA met and decided to go ahead with the strike decision. It is decided to intensify the campaign. Accordingly the Central JCA calls upon all the Branch/Divisional/Circle Union to organize MASS Dharna in front of all Circle/Regional/Divisional offices on 10.01.2012. It is also decided to organize candle-light protest demonstration/procession/rallies on all important places on 16.01.2012. Further all intensive campaign such as squad work, conventions, general bodies, press conferences etc may be organized at all levels. Make the indefinite strike from 17.01.2012 a historic success

Sujbect:- Notice of indefinite strike from 17.01.2012 served by Postal Joint Council of Action comprising NFPE, FNPO, AIl Postal Extral Departmental Employees Union and National Union of Gramin Dak Sevaks – Meeting of Members, Postal Services Board with the Postal Joint Council of Action.
This has refreence to note of even No. Dated 16.12.2011 dealing with notice for indefinite strike from 17.01.2012 served by Postal Joint Council of Action along with their 25-point Charter of Demands. Vide the above note, all Division heads were requested to furnish comments/Action Taken Reports in regard to the issues concerning them.
2. As decided with the approval of Secretary(Posts), the issues raised in the Charter of Demands will be discussed in the meetings to be taken by respective Members, Postal Services Board with the Postal Joint Council of Action on 27.12.2011 in Shri K.R. Murthy Room, Dak Bhawan, New Delhi as per timings indicated below:
(i). Member(P) will take meeting in the Forenoon stating at 10.30 AM.
(ii). Member(O) – 2.30 P.M.
(iii). Member(PLI) -3.30 P.M
(iv). Member(Planning) -4.30 P.M
All the concerned heads of divisions will make it convenient to attend the meeting along with updated comments/ATRs, which may also be sent to SR Section by 23.12.2011.
3. As regareds issue relating to Postal A/Cs Wing/Civil Wing, DDG(PAF)/CE(Civil) will take the meeting in the afternoon of 27.12.2011, timing for which will be fixed keeping in view convenience of both the sides.

OFFICF MEMORANDUM

Subject: Reservation for Other Backward Classes in Civil Posts and Services under               the Govt. of India — Sub-quota for Minority Communities.

            The undersigned is directed to invite attention to this Department's O.M. No.36012/22/93-Estt.(SCT) dated 8th September, 1993 regarding reservation for Other Backward Classes in civil posts and services under the Government of India.

2.         The Government of India had set up the National Commission for Religious and Linguistic Minorities to suggest criteria for the identification of the socially and economically backward sections amongst Religious and Linguistic Minorities and to recommend measures for their welfare, including reservation in Government employment. The Commission submitted its report to the Government on 10th May. 2007, wherein it had, inter-alia, recommended creation of a sub-quota for minorities from within the reservation of 27% available to OBCs, in Government employment.

3.         The Government have carefully considered the above recommendation and it has been decided to carve out a sub-quota of 4.5% for minorities, as
defined under Section 2 (c) of the National Commission for Minorities Act. 1992, from within the 27% reservation for OBCs as notified by the aforesaid O.M. The castes / communities of the said minorities which are included in the Central list of OBCs, notified state-wise from time to time by the Ministry of Social Justice and Empowerment, shall be covered by the said sub-quota.

4.         Similar instructions in respect of public sector undertakings and financial institutions including public sector banks will be issued by the Department of Public Enterprises and by the Ministry of Finance respectively.

5.         These orders will have effect from 1st January, 2012 and the O.M. No. 36012/22 93-Estt. (SCT), dated 8th September, 1993 stands modified to the above extent.

PFRDA BILL SHELVED ,A VICTORY TO WORKERS, A RESULT OF MARCH TO PARLIMENT

NEW DELHI: After being forced to keep on hold FDI in retail, Government faced fresh hurdles when two major legislations-- Pension Bill and the Companies Bill--had to be shelved in the face of dissent again from its ally Trinamool Congress(TMC) as well as from main opposition BJP.

TMC today made it clear that it was not in a position to support some of the provisions of the Pension Fund Regulatory and Development Authority (PFRDA) Bill just days after it forced Government to suspend the decision to allow 51 per cent FDI in multi-brand retail.

Sources said the government has decided to shelve the PFRDA and the Companies Bills in the ongoing Winter Session of Parliament as it does not have the necessary numbers to get it passed in the Rajya Sabha with BJP and Left parties also opposing the legislations

West Bengal Chief Minister and TMC Chief Mamata Banerjee is understood to have shot off a letter to Finance Minister Pranab Mukherjee today, stating her party's position on the important pension legislation.

As in the case of FDI in multi-brand retail, TMC's opposition to PFRDA is apparently due to political compulsions in West Bengal where her main political adversaries, the Left parties, have been campaigning for long opposing the measure.

One of the major issues on which TMC has voiced its opposition is the question of 'assured returns' on pension if a portion of it is invested in the stock market, sources said.

The sources said the Congress did not want to face the embarrasment of its ally TMC opposing this Bill in the House.

Mukherjee had earlier reached out to BJP to get its support for both the PFRDA and the Companies Bill. The government had agreed to the BJP demand to fix quantum of FDI for pension management in the PFRDA Bill itself and gave up its earlier proposal of bringing this through an executive decision.

Another demand of the BJP was on the issue of assured returns to retired employees.

Parliamentary Standing Committee on Finance, headed by BJP leader Yashwant Sinha, had also made this recommendation.

Dear comrades,

We express our sincere thanks to POSTAL JCA for their efforts to settle our demands. POSTAL JCA consisting of NFPE,FNPO &GDS UNIONS highlighted our demands and included them in the charter of demands of indefinite strike notice submitted to DG POST on 15-12-2011 which is going to be conducted from 17-01-2012.  

OUR MAIN DEMANDS INCLUDED IN THE CHARTER OF DEMANDS
1.      REVISION OF WAGES OF ALL CASUAL,PT CONTINGENT WORKERS ON PAR WITH REGULAR EMPLOYEES AS PER THE REVISED WAGES OF 6TH CPC  AND PAYMENT OF ARREARS FROM 1-1-2006.
While discussions with DG POST during last strike notice it was assured that orders will be issued for revised wages and drawl of arrears to pre 1993 workers with a month and for arrears to others it will be favorably sent to finance for approval. But the same was not implemented.

2.      REGULARISATION OF CONTINGENT WORKERS BY CONVERTING ALL PTP POSTS AS GDS AND UPGRADING THE PRESENT INCUMBANTS AS GDS AGAINST THOSE POSTS ON ONE TIME MEASURE.
After the discussions in our first convention it was decided to place this proposal before the committee appointed by the department on the issues of casual labor and the same was submitted to the CHARMAN of the committee by our federation. Now this was placed as demand in the strike charter by JCA .
3.      CONVERTION OF PTCL”S AS FTCL BY COMBINING THE POSTS OF PART TIME AND GRANTING TEMPORARY STATUS TO ALL PTCL’S BY REIRERATING  DOP ORDER NO. 45-14/92-SPB-I DT. 16-9-92.
Even though orders were issued earlier this was not implemented in many circles due to which years together casual employees were suffered without regularization. In the last agreement it was assured that the earlier orders will be reiterated. But till date orders were not issued. Now it was kept as demand in the charter.
  IN ADDITION TO THE ABOVE WE REQUEST THE JCA LEADERS TO KEEP THE FOLLOWING DEMANDS ALSO IN THEIR VIEW WHICH WERE RESOLVED IN THE 1ST ALL INDIA CONVENTION OF OUR FEDERATION.

1.      TO REITERATE THE EARLIER ORDERS OF DOP NO. 55-24/88-SPB-I DT. 17-3-89 CLARIFYING WHO ARE CASUAL LABOUR .OTHER WISE IN MOST OF THE CIRCLES MANY CASUAL LABOUR ARE NOT RECGNISED AS CASUAL LABOUR RAISING DOUBTS ON WHO SHOULD BE TRATED ASS CASUAL LABOUR.
2.      ALL THE PTCL’S WHO WORKED FOR 480 DAYS IN 2 YEARS MAY BE TREATED AS TEMPORARY STATUS CASUAL LABOUR FOR THE PURPOSE OF RECRUITMENT AS PER THE HON’BLE CAT HYD. JUDGEMENT IN OA NO. 388/1998 WHICH WAS RATIFIED BY AP HIGH COURT IN WP. NO. 17048/2000 AND SLP FILED BY THE DEPARTMENT IN APEX COURT WAS DISMISSED IN 2011. BUT THE SAME WAS IMPLIMENTED ONLY TO THOSE WHO APPROACHED COURT ONLY. AS SUPREME COURT DIRECTED THIS SHOULD BE APPLIED TO ALL THE PART TIME CASUAL LABOUR.
3.      AS PER THE COMMITMENT GIVEN TO JCA THE ORDERS OF THE DEPARTMENT TO GIVE PRIORITY TO CASUAL LABOUR IN GDS VACANCIES VIDE DOP. NO. 17-141/88-EDC&TRG DT. 6-6-88 MAY BE REITERATED AND IMPLIMENTED.
4.      ALL THE BENEFITS GIVEN TO UNORGANISED SECTOR WORKERS I.E. PENSION,ESI ETC MAY BE EXTENDED TO CASUAL LABOUS ALSO.
5.      TO ISSUE IDENTITY CARDS TO ALL CASUAL LABOUR WORKING IN THE DEPARTMENT AS MOST OF THEM ARE WORKING AGAINST REGULAR VACANCIES OF GDS,MTS,MG& POSTMAN.
6.      TO REVISE THE HOURLY RATE OF SDS KEEPING IN VIEW THE REVESIED WAGES OF REGULAR EMPLOYEES AND INCREASE IN DA AND LIMIT ON THEIR WORKING HOURS MAY BE EXTENDED TO 100 HOURS IN A MONTH.

KEEPING IN VIEW THE ABOVE ALL THE CASUAL, PARTTIME CONTINGENT& CONTRACT WORKERS ,SHORT DUTY STAFF WORKING IN THE DEPARTMENT TO PARTICIPATE IN THE INDEFINITE STRIKE FROM 17-01-2012 CONDUCTING BY POSTAL JCA AND MAKE IT A GRAND SUCCESS FOR BETTERMENT OF OUR SERVECES AND WORKING CONDITIONS.

1.      TO REITERATE THE EARLIER ORDERS OF DOP NO. 55-24/88-SPB-I DT. 17-3-89 CLARIFYING WHO ARE CASUAL LABOUR .OTHER WISE IN MOST OF THE CIRCLES MANY CASUAL LABOUR ARE NOT RECGNISED AS CASUAL LABOUR RAISING DOUBTS ON WHO SHOULD BE TRATED ASS CASUAL LABOUR.
2.      ALL THE PTCL’S WHO WORKED FOR 480 DAYS IN 2 YEARS MAY BE TREATED AS TEMPORARY STATUS CASUAL LABOUR FOR THE PURPOSE OF RECRUITMENT AS PER THE HON’BLE CAT HYD. JUDGEMENT IN OA NO. 388/1998 WHICH WAS RATIFIED BY AP HIGH COURT IN WP. NO. 17048/2000 AND SLP FILED BY THE DEPARTMENT IN APEX COURT WAS DISMISSED IN 2011. BUT THE SAME WAS IMPLIMENTED ONLY TO THOSE WHO APPROACHED COURT ONLY. AS SUPREME COURT DIRECTED THIS SHOULD BE APPLIED TO ALL THE PART TIME CASUAL LABOUR.
3.      AS PER THE COMMITMENT GIVEN TO JCA THE ORDERS OF THE DEPARTMENT TO GIVE PRIORITY TO CASUAL LABOUR IN GDS VACANCIES VIDE DOP. NO. 17-141/88-EDC&TRG DT. 6-6-88 MAY BE REITERATED AND IMPLIMENTED.
4.      ALL THE BENEFITS GIVEN TO UNORGANISED SECTOR WORKERS I.E. PENSION,ESI ETC MAY BE EXTENDED TO CASUAL LABOUS ALSO.
5.      TO ISSUE IDENTITY CARDS TO ALL CASUAL LABOUR WORKING IN THE DEPARTMENT AS MOST OF THEM ARE WORKING AGAINST REGULAR VACANCIES OF GDS,MTS,MG& POSTMAN.
6.      TO REVISE THE HOURLY RATE OF SDS KEEPING IN VIEW THE REVESIED WAGES OF REGULAR EMPLOYEES AND INCREASE IN DA AND LIMIT ON THEIR WORKING HOURS MAY BE EXTENDED TO 100 HOURS IN A MONTH.

KEEPING IN VIEW THE ABOVE ALL THE CASUAL, PARTTIME CONTINGENT& CONTRACT WORKERS ,SHORT DUTY STAFF WORKING IN THE DEPARTMENT TO PARTICIPATE IN THE INDEFINITE STRIKE FROM 17-01-2012 CONDUCTING BY POSTAL JCA AND MAKE IT A GRAND SUCCESS FOR BETTERMENT OF OUR SERVECES AND WORKING CONDITIONS.
