RESOLUTIONS PRAPOSED BY AIPCPCCWF,CHQ TO APPROVE IN FEDERAL EXECUTIVE HELD ON 13-2-21 AT BANGALORE AND PASSED.
1. First of all we convey our sincere thanks for the cooperation extended to our federation in forming circle branches of our union and all the programmes organized by our union till today. In spite of your support till date circle branches could not be formed due to one reason or other. Particularly in UP, BIHAR, HARYANA, PUNJAB, MP, CHATTISGARH, RAJASTAN, KARNATAKA, GUJARAT circle union branches could not be formed and even though formed in JHARKHAND it is not functioning. In this back ground in the recently held CWC at Chennai , after thorough discussion it was decided to make an appeal to all GENERAL/CIRCLE SECRETARIES to extend your cooperation in forming circle branches in those circles mentioned above.
Without your support and solidarity it is impossible to fulfill the task of forming circle union branches in the above circles and organize any programme of action to solve the demands of casual, contingent & contract workers. All general/circle secretaries of NFPE AFFLIATED UNIONS/ASSOCIATIONS are requested to extend support in forming circle branches at the earliest.
2. NON IMPLIMENTATION OF DIRECTORATE ORDERS ON PAYMENT OF WAGES TO CASUAL, CONTINGENT EMPLOYEES.
It was brought to the notice of this union that even in many divisions new wages were not drawn till today even though long time passed after orders issued by Directorate. In this connection we would like to bring to the notice of kind Secretary,Dept.of Posts, that even though the orders are very clear on the subject unwanted clarifications are raised only with an intention of not implementing the orders on one plea or other.It is learnt that some clarifications are seeking by some authorities.
We would like to bring to the notice the fallowing orders of DG POST which will solve many issues.
A] As per DG POST orders 55-24/88-spb-1 Dt. 17-3-1989 all the following officials are casual labor.
“it is here by clarified that all daily wagers working in post offices or in RMS offices or in administrative Offices, PSD/MMS under different designations Mazdoor, casual laborers, contingent paid daily wager, daily rated mazdoor.
These casual laborers who are engaged for a period of 8 hrs a day should be described as full time casual labor, who are engaged less than 8 hrs a day should be described as part time casual labor.
All other designations should be discontinued.”
No further orders are required for clarification. But unfortunately this was totally ignored and time and again seeking clarifications on the subject.
B] Another point is being raised by some stating that vide DG POST orders 4-4/2009-PCC DT 19TH NOVEMBER 2010 all ptcl are dispensed. In this connection we would like to bring to the notice that the intention of the
order is that as the duties of these categories are entrusted to MTS it was stated to entrust this work to MTS by dispensing this cadre. But subsequently these orders entrusting contingent work to MTS were kept in abeyance and subsequently the same is being clarified very clearly that the existing staff need not be dispensed with. It is clarified that the intention of the orders is that no contingent or casual labor be appointed after 1-12-2010.
C] Accordingly no ptcl working should be dispensed. But unfortunately new ptcl are being engaged freely by the authorities without following the guidelines. In spite of our complaints no action was taken against those who violated the orders and engaged new casual labor according to their whims and fancies. For the fault of them poor ptcl working should not be punished by not paying revised wages.
D] Even though there are clear orders no uniform payment is implementing in the divisions. Payment is made according to their will in each division. All the above mentioned ptcl are being paid wages as per 5th pay commission fixed wages. They are to be paid as per 6th pay commission wages revised & fixed by directorate in their order mentioned above from 1-1-2006 & further to be revised to rs.18000/- pm as per 7th cpc wages and arrears should be paid from 1-1-2006 & on par with 7th cpc wage 18000/- from 1-1-2016 as per directorate orders. There is no confusion or ambiguity in the orders.
E] This inaction towards low paid employees who are playing key role in the main programme of present govt.“SWACH BHARAT” is nothing but depriving their legitimate wages. Without their sincere participation any publicity by authorities by involving in their duties on one day will not made our country “SWACH BHARAT” and the dream of present GOVT. will never fulfill.
3. NON PAYMENT OF ARREARS AS PER DIRECTORATE ORDERS TO PTCL/FTCL IN MANY CIRCLES.
As such SECRETARY Dept.of Post is requested to issue clear instructions for payment of arrears immediately without further delay.
4. ABSORPTON OF PTCL/FTCL AGAINST GDS VACANCIES & MTS VACANCIES.
Orders were issued in c/w 7th cpc to absorb eligible casual labour in GDS vacancies by directorate but unfortunately the same were withdrawn subsequently without any reason because of which number of eligible casual labour are deprived of regularization. As such the orders issued earlier may be restored and eligible casual labour may be absorbed against GDS vacancies before giving notification for recruitment. The present notification issued for recruitment may be stopped forthwith.
5. IMPLIMENTATION OF RECENT APEXCOURT CLARIFICATORY JUDGEMENT REGARDING REGULARISATION OF IRREGULARLY APPOINTED CASUAL LABOUR WHO RENDERED 10 YEARS SERVICE.
Earlier Apex court delivered judgment in Umadevi vs. Karnataka govt. to regularize irregularly appointed casual labour who completed 10 yrs service by July 2010. recently again Apex Court clarified that one time measure has to be applied to every casual labour after completion of 10 yrs service . As such SECRETARY POST is requested to issue orders basing on recent apex court judgment and help casual labour who worked for 10 yrs in the Department.
