Sub:- Submission of resolutions passed in the AIC of AIPCPCCWF held at Badnera, Amravati, Maharashtra-reg.

Respected Madam,

NFPE convey its thanks for issuing clarificatory orders to CPMG Kerala and Andhra for payment of revised wages to PTCL/FTCL and arrears. We request the Madam to forward the same instructions to all circles as the issue is still pending in some circles.

I am here with forwarding the resolution passed in the recent All India conference of AIPCPCCWF held at Badnera, Amravati, Maharashtra from 27th to 28th December 2015 which is self explanatory.

I would like to bring to your notice that the resolutions passed are in r/o non implementation of various orders issued by Directorate from time to time at lower level, which resulted in unrest among the low paid employees of the Department.

You are requested to intervene and issue instructions to implement all those orders mentioned in the memorandum without further delay, so that the low paid employees of the department will be rendered justice and avoid unrest among the workers.

Sub:- Request for extending the facility of meetings to AIPCPCCWF at all levels –reg

Respected Madam,

In the recently held All India conference of AIPCPCCWF a resolution was adopted requesting extension of periodical meetings facility to their federation at all levels as provided to various organizations/ associations even though they have not participated in the verification and not get required  membership.

In this connection I would like to bring to your notice that this federation in association with NFPE is representing more than 50,000 employees working in the Department. If the facility of periodical meetings is extended to this federation it will help for better functioning of the Department .

AS SUCH, YOU ARE REQUESTED TO TAKE UP THE ISSUE WITH UTMOST PRIORITY AND EXTEND THE FECILITY OF PERIODICAL MEETINGS AT AN EARLY DATE.

Sub- Request for reiterate the instructions issued earlier in r/o casual labour - reg.

Respected Madam,

I would like to bring to your notice that in many circles casual labour are denied of their legitimate benefits on the plea that they are not casual labour.

In this connection I would like to bring to your notice the orders issued by Dept. of Post vide lr. No. 65-24/88-SPB-1 dated 17-5-1989 basing on the historical judgment of HONBLE SUPREME COURT clarifying that all employees working on casual nature including daily rated mazdoors are casual labour. Only classification is full time and part time.

As such you are requested to reiterate orders once again so that the confusion prevailing in lower level will be removed.

An early action is requested.

RESOLUTIONS PASSED IN THE 1ST AIC OF OUR UNION HELD AT BADNERA[ MAHARASTRA] FROM 27TH TO 28TH DEC 2015ON THE PROBLEMS OF  CASUAL. PART TIME, CONTINGENT & CONTRACT WORKERS OF THE POSTAL DEPARTMENT.

RESOLUTION-1.

The first AIC of AIPCPCCWF HELD AT Badnera[ Amravati] Maharashtra from 27th to 28th Dec 2015 discussed all the problems faced by the casual, part time contingent and contract workers of postal department and following decisions are taken.

1.      The AIC expressed its sincere thanks to NFPE for the cooperation extended in settling the problems of casual laborers particularly the revision of wages with effect from 01-01-2006. Without the intervention and struggle conducted by NFPE this would not have settled. Even though clear orders are issued by the directorate to revise the wages of casual laborers either part time or full time on the basis of pay band and grade pay of erstwhile Gr’D’ ie. PB 5200+ GP 1300+ corresponding DA from 1-1-2006, in most of the postal circles the same is not being implemented and arrears are not paid. in Andhra and Kerala circles , circle level agitation programmes are organized along with NFPE and the CPMsG issued orders for payment basing on the clarificatory orders issued by the directorate without giving any room for any ambiguity. Still in many circles, the circle/divisional administration is not ready to make arrears payment w.e.f 1-1-2006 as ordered by the directorate. This 1st AIC demands the postal board and circle/ regional/divisional administration to implement the directorate orders in all divisions and revised wages and arrears wef 1-1-2006 may be paid to all without any further delay.





       2.  Even though there are clear orders to regularize the full time casual labor who worked for 240 days in a year and part time casual labor who worked for 240 days a year for two years and various courts including SUPREME  COURT delivered judgments including the judgment in UMADEVI Vs KARNATAKA STATE still these orders are not being implemented in many circles. Further as per the MTS recruitment rules 25% of the vacancies are to be filled by full time or part time casual labor that was also not being implementing in many circles/divisions. This AIC demands the postal department to take immediate action to regularize all casual, part time and contingent employees working in the postal department in a time bound manner.


                 3..In some circles the outsiders [not GDS] working as substitutes in the vacancies
                     of postmen/MTS are not being paid pro rata wages of postman/ MTS. this AIC      demands that all substitutes [whether GDS or out siders] working in the vacant posts should be paid pro rata wages. Further it is demanded that the substitutes may be paid all benefits such as transport allowance, HRA etc. on prorate basis.

4.All present daily rated mazdoors [DRM] working against the departmental posts are not being paid the wages of the departmental employees. This AIC demands that all DRM working in the departmental posts shall be paid pro rata wages of the post  in which he is working.


5.This AIC demand that the benefits of EPF/ESI/PENSION shall be extended to all casual, part time contingent and contract workers, working in the postal department.

6.      This AIC demands that as and when Dais declared and implemented for departmental employees , revised DA from the same date should be paid to all casual, part time contingent employees also without waiting for any further orders from directorate.


7.      While fixing the working hours based on the standards for sweepers and other PTCL the minimum working hours should be fixed as 3 hrs per day. If the duty hours exceed five hours the post may be converted as full time and the official working in that post may be treated as full time casual labor.






8.      This 1st AIC demands that SUNDAY and holiday wages should be paid to all casual, part time and contingent employees, who work continuously for six days in a week. The beak coming on account of holiday should not be treated as a break when six continuous working days are taken.

                       9.In spite of clear modificatory orders from directorate that those casual, part time and contingent employees who are working should not be terminated and their work should not be out sourced, some of the officers [e.g. SSPO’S AMARAVATHI DN, MAHARASTRA,NAGPUR REGION] are issuing orders terminating the services of casual labor. This AIC DEMANDS THE AUTHORITIES TO STOP SUCH INHUMAN PRACTICE and reinstate all casual laborers whose services are irregularly terminated.

This first AIC of AIPCPCCWF held at BADNERA further resolves that:
In case of all the above mentioned demands of casual, part time, contingent and contract workers are not settled by the postal board before the end of January 2016, the following agitation programme will be organized in a phased manner.

                                                PROGRAMME:-

A] MASS DHARNA INFRONT OF POSTAL DERECTORATE DURING THE 2ND WEEK IF FEB 2016.

B] DHARNA IN FRONT OF ALL CHIEF PMG OFFICES DURING THE SECONDWEEK OF MARCH 2016.

C] DHARNS IN FRONT OF ALL DIVISIONAL OFFICES DURING THE 2ND WEEK OF APRIL 2016.

D] EVEN THEN THE ISSUES ARE NOTSETTLED INDEFINATE HUNGER FAST FOLLOWED BY STRIKE WILL BE DECIDED BY NEXT CWC.     












RESOLUTION-2:-

This 1st AIC of AIPCPCCWF held at BADNERA from 27th to 28th Dec 2015 while thanking the National JCA for including the demand of regularization of casual and contract workers also in their charter of demands submitted to Govt. calls up all casual and contract workers of the postal department to make all the agitation programmes of NJCA including indefinite strike a grand success.


RESOLUTION: 3

This 1st AIC demands the postal department to extend the facility of formal meetings with officers of the department at all levels to our federation which represents 46000 casual employees in the department to discuss and settle the issues  of casual ,part time, contingent and contract workers which will result in better functioning in the department.


RESOLUTION: - 4.

This AIC in session express our anxiety and displeasure over the developments happenings in our country which spoil the social harmony, plurality and threat to our unity and integrity posed by the communal forces in our country. In the name of religious and cast discrimination brutal killings are reported from many parts of the country. Communal violence is taking place and the poor helpless persons are being targeted in these violence. This AIC demands the present GOVT. headed by Sri. NARENDRA MODI JI to intervene in the matter and take steps to stop such violence immediately so that peace and fraternity could be restored and in maintained in the country.

RESOLUTION: - 5.

This AIC notes that the intolerance is developing in our country and the writers, scholars, educationalists and great historians are targeted by the communal fundamentalist forces and brutal killings and tortures were taking place in our country. We condemn such anti national and anti social activities of the communal fundamentalist forces and demand the central and state governments to take stringent action to stop such actions of intolerance. Further some communal fundamentalist forces are dictating what should be included in our food items and what should not be. Violent killings were taken place. Instead of keeping silent the Hon’ble






PRIME MINISTER is demanded to intervene in the matter and take action to stop such intolerance developing in the country.


RESOLUTION:- 6

This AIC demands that the policy of NDA govt. on corporatization and privatization should be reversed and public sector may be given importance in our national economy and thereby employment opportunity may be increased which will help to reduce the problem of unemployment and help our economy to a great extent. We also demand to stop selling of shares of public sector units and govt. maintained institutions tomultinationals and national corporate houses.


RESOLUTION:-7. :- ON GDS RECRUITMENT:

This AIC unanimously demands immediate intervention of Postal Directorate and issue instructions to all the circles resorting to the ongoing recruitment process of GDS undermining the orders of the directorate to first exhaust the list of eligible casual labor for the recruitment to GDS posts [e.g. TAMILNADU CIRCLE except Tambar am Dn] to stop the process immediately and follow the directorate orders strictly. The Postal Directorate issued orders vide. Lr. No. 17-15/2015-GDS dated 7-5-2015 addressed to CPMG Karnataka circle and endorsed to all circles. Many divisions are going ahead to fill the vacancies ignoring the above orders. This AIC resolves to urge upon the Directorate to intervene and cause to stop the irregular process against the orders of directorate and ensure implementation of directorate orders strictly in all circles/ divisions.

THIS AIC ALSO DEMANDS THE DIRECTORATE TO MODIFY THECONDITION OF 10TH CLASS PASS COMPULSORY FORABSORPTION AGAINST GDS POST FOR CASUAL LABOUR, AS THISIS NOT REQUIRED FOR GDS MM, PACKER AND OTHER POSTS. AS SUCH WE DEMAND THE DIRECTORATE TO RELAX THAT CONDITION SO THAT NUMBER OF CASUAL LABOUR WILL GET THE CHANCE FOR REGULARISATION.













RESOLUTION: - 8.
This AIC demands the directorate to circulate the orders issued by the directorate vide its lr. No. 65-24/88-SPB-1 dated 17-5-1989 clarifying who is casual labour. Many circles /divisions are violating these instructions and denying revised wages and arrears from 1-1-2006 stating that they are not casual labors. This  AIC demands the directorate to reiterate the orders once again to avoid confusion in the circles/ divisions and all PTCL/FTCL will be paid revised wages with arrears.


RESOLUTION:9

This AIC demand the directorate to redeploy the GDS posts transferred to postal divisions from RMS divisions’ earlier due to proposal of abolition of GDS posts in RMS. Now orders are issued to restore the GDS posts in RMS and fill those posts. In this back ground if these posts are not diverted back to RMS divisions the casual labor working in those divisions will be deprived of their legitimate right of absorption. As such we demand the directorate to issue orders to retransfer those posts to RMS immediately and fill up those posts from the eligible casual labor of that Division.

  This AIC OF AIPCPCCWF held at BADNERA [MAHARASHTRA] from 27th to 28th Dec 2015 unanimously resolved to join in all programmes of campaign and struggles including strike conducted by CENTRAL TRADEUNIONS JCA.

OFFICE MEMORANDUM
Subject:- Discontinuation of Interview at Junior Level Posts in the Government of India- recommendation of Committee of Secretaries.
The undersigned is directed to refer to this Department’s D.O. of even number dated 04.09.2015 and subsequent OM’s dated 09th October, 2015, 09th November, 2015 on the above subject seeking detailed information on the progress made/action taken in the matter.
2. It is informed that Secretary (Personnel) had convened meetings on 14th December, 2015 and 17th December, 2015 to review the progress of implementation of the “No Interview Requirement Proposal” and to get the updated status on the decision/progress made by the various Ministries/Departments. Keeping in view the queries raised by the representative of various Ministries/Departments the following is once again clarified:-
(a) The decision to discontinue interview for recruitments is for all Group ‘C’, Group (which are now reclassified as Group ‘C’) Posts and for non gazetted posts of Group ‘B’ Category and all such equivalent posts.
(b) The ‘No Interview Requirement” proposal has to be implemented for all the junior level posts in Government of India Ministries/Departments/attached Office/Subordinate Office/Autonomous Bodies/Public Sector Undertakings.
(c) Instructions issued by the Department of Public Enterprises on 14 th December, 2015 vide OM No. DPE-GM to all Administrative Ministries concerned with CPSES under them with advice to dispense with the practice of interview (copy enclosed).

(d) The timelines set regarding completing the process of the discontinuation of interview by 31.12.2015 has to be adhered to strictly. From 01 st January, 2016 there will be no recruitment with interview at the junior level posts as mentioned at 2(a) above, in Government of India
Ministries / Departments / attached Office / Subordinate Office / Autonomous Bodies / Public Sector Undertakings. All the advertisement for future vacancies will be without the Interview as part of the recruitment process.
(e) The interviews will be done away even in cases where in the past the selections used to be made purely on the basis of performance in the interview. The Ministries/Departments/Organizations’ will consider revising the scheme for selection for such cases.
(f) It is also clarified that as Skill Test or Physical Test is different from Interview, and they may continue. However, these tests will only be of qualifying nature. Assessment will not be done on the basis of marks for such tests.
(g) In case of specific posts where the :Ministry/Departments wants to continue undertaking Interview as a process of recruitment, a detailed proposal seeking exemption will have to be sent to the DoPT with the approval of the Minister/Minister In-Charge.
3. All the Oentral Ministries/Departments are therefore requested to ensure that necessary action in respect of their Ministry/Department/Organizations are completed within the stipulated time.
A consolidated report with the details of the decision taken/progress made in this regard should also be furnished to this Department at the earliest and not later than 7th January, 2016. Report so to be furnished with the approval of the Minister/Minister In-Charge shall include the details of the name and number of posts where the interview is discontinued and posts for which the exemption has been sought within the purview of the administrative Ministries/Departments.
