for review of decision communicated to CPMG, AP Circle on casual labor wages-

Respected Madam,
It
is very unfortunate to bring to the kind notice of madam, the wrong
interpretation given to DOPT OM No 49014/2/86 ESH (e) DT: 07.0.1988 in the
connection to CPMG AP Circle vide letter cited U/R
In the above letter it was interpreted
as follows
The
acceptance of 6th CPC recommendations contained in Para 3, 7, 9, the
Government vide resolution notified in Gazette No.304 dated 29-8-08 and all
erstwhile Group-D posts were upgraded to Multi-tasking Staff in Group C
effective from 01-01-2006. The Department notified their multi-tasking
functions vide OM NO.1-20/2008-PCC dated 24-09-2010. Thus, keeping in view the
multi-tasking nature of duties assigned to these MTS, the work performed by
regular employees and that of casual laborers ceased to remain the dame and as
such these casual workers can’t be paid at the minimum of the pay scale of MTS,
which is in Group C. There is no Group-D pay scale in the Government any more.
But
it is to mention that the contention of the directorate is not correct because
already one separate scale is recommended by 6th CPC and implemented
which is PB 4440 and GP 1330. Clear orders were issued to convert all Group-D
officials by giving training as MTs and then only MTS scale was given. Till
that type they were paid wages on IS payband that is Group-D scale.
It is not out of place to mention here
that already as per the judgment of honorable CAT Chennai orders were issued by
directorate to pay wages to casual labors
working against MTS vacancies as per minimum of IS payband that is 4440
+GP 1330 and corresponding DA.
The present decision directing the
CPMG AP circle to file case in high court deviating the earlier orders will
attract contempt of court and deviation to earlier orders.
As such secretary is requested to
review the decision once again and earlier orders may be reiterated immediately
and help the poor casual employees who are denied of legitimate wages.
We also request the madam to consider
and issue orders for payment of DA to contingent employees who are deprived
from 2010.
We expect that madam will respond
positively.
